Yale-Man, this is awesome, and I'd like to buy two of these FER SURE. But as a fan, I'm a little concerned... could DC/Disney come after you for this? You've got Flash's symbol on there and the JL8 logo. (Please don't get in trouble!!! We don't want you getting any more "cease and desist" letters from some bully corporation!!)
Of everything Yale's done, this is by far the safest. The lightning bolt is just that--a lightning bolt--as the official Flash logo is distinct and different. "Now we boogie" is a riff on 70s disco fonts not trademarked or associated with anything other than a best-forgotten era of misguided music.
And DC is owned by Warner. Disney doesn't care one way or the other.
My bad! I can't believe I made that mistake. Disney bought Marvel, and DC is owned by The WB. (All this "parent company" stuff really messes with my head.)
Also, I'm honestly not sure about the lightning bolt -- that could be my mistake as well, but I've seen it rendered a lot of different ways. If something is SUGGESTIVE of another property, could the copyright holder raise a stink? I really don't know, that's why I'm asking.
I definitely get that the "boogie" message (awesome, btw) isn't affiliated with DC Comics, but I got worried when I saw that logo.
As a long-time fan of JL8, when I saw this merch, I initially got excited! But the fact that it's merch that's kinda-sorta related to copyrighted stuff -- THAT'S where my initial post was coming from.
Do you honestly think it's SAFE? That's all I'm really asking.
This particular design? Pretty much safe. Now, if Yale started selling shirts with his version of the characters on them, I'd expect him to get a call very quickly from Warner attorneys. As long as he sticks to the tangential elements, he should be fine.
Ultimately, he could claim JL8 is a parody, which courts have given pretty wide definition to (that's how all those super-hero/Star Wars porn videos have proliferated in recent years). But I'm pretty sure that's not what Yale wants, as I get the impression he does this strip out of love and would prefer to avoid confrontation. He's been pretty savvy thus far.
